Can be culled from this thoughful discussion (FYI, the pro-Oregon arguments are from one of my favorite conservative/libertarian legal writers, Jonathan Adler, whose writings on envrionmental issues are vital). This is the nunace you don’t get from news reports that suggest John Ashcroft stomped an iron boot on state’s rights. I essentially agree with both the pro and con arguments here, so that doesn’t make me very helpful.
